All users (hereinafter “user”, “users”, “you”, “your”), that navigate or wish to buy some of our products and services must read these website terms of use (the "terms of use") carefully before using this website. These website terms of use govern your access to and use of the website. The website is available for your use only on the condition that you agree to the terms of use set forth below. Selling Terms

All the selling terms are in full force each time you proceed with an order for the products offered at the website and constitute the full agreement between you and Ultraship for the products purchased. In case that you do not agree with any of the terms included in these Terms of Use you must not use the website either proceed with any transaction. If any term of these Terms of Use is considered by the competent court invalid or illegal, then it is not applicable, but all the other terms shall nevertheless remain in full force.

1.Subscription:
Ultraship provides you the option to purchase products and services through the website. More specifically, you can select and build your own shipboard manual as well as to proceed with the annual subscription. The annual subscription is paid per each manual, once you pay the yearly fee for the manual of your option, then you can produce unlimited number of this specific manual that you selected for all your ships. When you use our platform to build your shipboard manual, we always review the document before sending you the final version. Then you can use the Comments Form in order to provide us your comments, after your review of the Shipboard manual that has been submitted to you as well as to provide us any comments that arise from the classification society or the flag authority of the ship (hereinafter collectively “the Authorities”) in case that the manual needs their approval accordingly. In this case, you submit them to us, and we amend the manual for free.

2. Payment:
2.1. You can proceed with the payment by choosing one of the following payment methods:
a) Direct bank transfer,
b) Using Paypal,

2.2. If, for any reason the payment is not completed, the sale is not completed, and we do not bear any responsibility.

2.3 The respective Bank and PayPal are responsible for ensuring the security of the environment for entering your credit card details where you will be transferred during the transaction. In the case of online payments with the use of credit card, we may access and store some basic information you provide during the transaction, is such case we use all reasonable technical and organisational measures to keep your information safe. In case of a malicious use of your card, the charge can be refunded following a request to the Bank issuing the card. You are obliged to notify your Bank as soon as you become aware of such an event.

3. Use of product:
If you purchase a product by the website, you are not authorized to provide it to any third party, except for cases that we have provided our explicit consent. In case of proven infringement of this term, you will be requested to pay a compensation of 100 times the price of the annual subscription of the specific manual that was reproduced without our permission.

4. Verification of data for the delivery of the Shipboard Manual:
When you register with us, we will ask you to provide us with the Management Company’s Name and the relevant IMO No. This information will be identified with the relevant information that you will provide us during the creation of your own Shipboard Manual. More specifically, we will verify the information included in the Safety Management Certificate (Management Company’s Name, Management Company’s IMO No. and ship’s name) in relation with the information provided during your registration. If the information does not match, then you will receive a notification email and we will not provide you with the Shipboard manual until the completion of the verification procedure.

5. Disclaimers and liability:
We always update our products according to the business needs and the relevant national and European laws; All Shipboard Manuals, online forms and any other file provided to you or downloaded by the website consists manuals in order to assist your internal organisation. These manuals should be further adapted in order to meet your specific business needs and should be further updated according to any arising law requirements. Ultraship shall not be liable for any direct or indirect damage resulting from the use of the Shipboard Manuals. To the extent permitted by law, the total liability of Ultraship, for any claims under these terms, you agree to hold harmless and indemnify Ultraship from any claim, suit or action arising from or related to the use of the product or the services or violation of these terms, including any liability or expense arising from claims, direct or indirect losses and damages.

6. Confidentiality:
Any corporate information submitted for the completion of the shipboard manuals is treated as strictly confidential and shall be used only for the purpose for which it has been submitted.

Errors - Inaccuracies

Occasionally there may be information on our website or in the services that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

Limitation of Liability Regarding the Use of the Website

Ultraship should be responsible only for actual damages, to the extent that this is permitted by applicable law.
